Abstract
Trybunał Sprawiedliwości Wspólnot Europejskich pełni rolę sądu międzynarodowego, konstytucyjnego, administracyjnego, pracy, cywilnego i trybunału arbitrażowego. Celem niniejszego opracowania je st przybliżenie sposobu, w jaki TS realizuje zadania sądu administracyjnego. Początkowe uwagi artykułu poświęcone będą wyjaśnieniu i uporządkowaniu podstawowych pojęć z omawianego zakresu, a także przedstawione zostaną pokrótce zagadnienia organizacji obu organów sądowych Wspólnoty. Następnie omówione zostaną uregulowania prawne dotyczące postępowania o unieważnienie (stwierdzenie nieważności) aktu wspólnotowego. Rozważone zostaną po kolei następujące zagadnienia: zaskarżalne akty, legitymacja procesowa, przesłanki stwierdzenia nieważności i skutki prawne orzeczenia Trybunału wydanego w omawianym postępowaniu. The Court of Justice of the European Communities acts as an international, constitutional, administrative, labor, civil court and arbitration tribunal. The aim of this study is to present the manner in which TS carries out the tasks of an administrative court. The initial remarks of the article will be devoted to the explanation of basic concepts in the area discussed. Issues of the organization of both Community judicial bodies will briefly be presented. Next, the legal regulations concerning proceedings for annulment of a Community act will be discussed. The following issues will be considered: challengeables acts, admissibility of action, bases of annulment and its consequences.
