Uzasadnienie projektu ustawy o zmianie Konstytucji – aspekty praktyczne

Abstract

Uzasadnienie projektu ustawy o zmianie Konstytucji musi być załączone za każdym razem, gdy wnioskodawca składa projekty ustawy o zmianie Konstytucji do Sejmu. Regulamin Sejmu w art. 34 ust. 2 określił, co powinno zawierać uzasadnienie. Brak uzasadnienia do projektu ustawy o zmianie Konstytucji skutkuje tym, że Marszałek Sejmu może zwrócić projekt wnioskodawcy celem uzupełnienia. Nieuzupełnienie braków w uzasadnieniu powoduje, że inicjatywa ustawodawcza o zmianie Konstytucji nie rozpoczyna procesu ustawodawczego. Uzasadnienie do projektu ustawy o zmianie Konstytucji jest koniecznym elementem do wszczęcia procedury ustawodawczej w Sejmie.
