Samorząd gminny jako gwarant efektywności korzystania z wolności zgromadzeń

Abstract

Artykuł opisuje polską regulację wolności zgromadzeń w obliczu nadchodzących zmian normatywnych, wywołanych wyrokiem Trybunału Konstytucyjnego z 2014 r., jak również stanowiących reakcję na bieżące wydarzenia. W niezbędnym zakresie definiuje konstytucyjną wolność zgromadzeń i ogólne zasady kreowania jej ograniczeń. Przede wszystkim omawia ją z perspektywy szczegółowych kompetencji samorządu gminnego mających zapewnić realne korzystanie z wolności zgromadzeń, jak również mogących zakłócić efektywne korzystanie z niej.

The article describes the Polish law regarding the freedom of assembly, mainly from the context of normative changes provoked by the 2014 judgement of the Constitutional Tribunal and recent happenings in the public sphere. To some extent the constitutional freedom to assembly and the general principles of its limitation are defined. Mainly, however, it is described from the perspective of detailed competences of the municipal government. These should ensure the effective usage of the freedom to assembly, but are likely to disrupt it as well.
