CeON Repository Terms of Use
1. Preliminary Provisions

These Terms of Use set forth rules for using the digital repository of scientific works (“Repository”) operated by the Interdisciplinary Center for Mathematical and Computational Modeling, the University of Warsaw, with its registered office in Warsaw (00-927), at Krakowskie Przedmieście 26/28 (“ICM UW”), via internet service available at: https://depot.ceon.pl/.

The Repository serves the purpose of making available over the Internet scientific works (journal articles and other publications or their parts, conference papers, reports, doctoral dissertations (“Materials”).

Through the Repository, it is possible to:

store Materials and make them publicly available;

browse and download Materials.

The use of the Repository is free of charge.

In order to use certain additional features of browsing and downloading Materials (such as collection subscription, receiving notification on updates), as well as to store and make Materials publicly available, user registration is required. It is possible to use anonymously functions not requiring registration, and apart from getting registered users are not obliged to disclose any data allowing their identification.

In order to use the Repository it is not necessary to fulfill any particular technical requirements, although it may be needed for using some of its functions. Information on such specific requirements is available on regular basis via the Repository.
2. Storing and Making Materials Publicly Available

A registered user can store and make Materials publicly available in the Repository, and use its additional functions in accordance with the current technical state of the Repository.

Only registered users can store and make Materials publicly available in the Repository.

A registered user remains liable for any actions carried out through their account in the Repository.

It is forbidden to provide content of illegal nature, and in particular to store and make available in the Repository the Materials:

to the dissemination of which the user is not duly authorised (e.g. their proprietary copyrights have been transferred to a third party);

the dissemination of which violates the rights of third parties in any other way, including their personal rights;

the dissemination of which is in conflict with other applicable laws.

It is forbidden to provide content contrary to accepted principles of morality, including content breaching the principles of scientific integrity.

It is forbidden to provide content not constituting Materials within the meaning of these Terms of Use.

ICM UW may refuse to store and make publications publicly available, block access or remove from the Repository data not constituting Materials within the meaning of these Terms of Use, as well as data that do not comply with the provisions of these Terms of Use.

With respect to each Material submitted by them to the Repository, users can make a declaration of granting a license, which may be selected from a list available in the Repository. The declaration mentioned in the sentence above shall be made by means of a relevant form available to registered users, while entering metadata regarding the Material.

ICM UW shall inform the Repository users about the declaration of granting a license, by means of relevant statement on the page devoted to a given Material. In case such declaration is not submitted, ICM UW shall inform the Repository users that using such Material is possible in compliance with relevant provisions of fair use or of user’s freedoms as provided by law, and usage in a broader scope requires the consent of entitled party. The entitled party can give consent, in particular, in the description or in the content of the submitted Material.

Where in the relations between a user and ICM UW the parties are bound by these Terms of Use and provisions of the licence mentioned above, and there would be a conflict between provisions of these documents, Terms of Use hereby should prevail.
3. Browsing and Downloading Materials

Browsing and downloading Materials marked as made available under a license, as well as using them in another way is possible in accordance with provisions of this license.

Provision of the preceding paragraph shall not apply to the Materials that were not marked as made available under a license. Usage of such Material is possible in compliance with relevant provisions of fair use or of user’s freedoms as provided by law, and usage in broader scope requires the consent of the entitled party. In particular, such consent can be expressed in the description or in the content of the submitted Material.
4. Complaints

If there are any complaints, they shall be notified via registered mail to the address: Interdyscyplinarne Centrum Modelowania Matematycznego i Komputerowego, Uniwersytet Warszawski, ul. Pawińskiego 5a, 02-106 Warszawa.

The notification shall contain the designation of a claimant allowing their identification and a short description of a problem.

ICM UW shall consider the notification without delay, upon notice sent to the claimant’s address given in the notification.
5. Personal data - information for registered users

The Administrator of the Users' personal data is the University of Warsaw (UW) with its seat at 26/28 Krakowskie Przedmieście Street, 00-927 Warsaw. Users can contact the Data Administrator in one of the selected forms made available on the website: https://www.uw.edu.pl/kontakt/.

The Administrator appointed a Data Protection Inspector (DPO), who supervises the correctness of personal data processing at the University of Warsaw. Users may address the DPO only in matters concerning the processing of personal data by the University of Warsaw. Users may contact the DPO by e-mail, sending a message to the following address: iod@adm.uw.edu.pl.

Users' personal data is processed in order to maintain the Repository.

The following personal data of Users are processed for the operation of the Repository:
- name and surname;
- e-mail address;
- password in encrypted form;
- IP address.

Personal data is processed on the basis of Article 6(1)(b), (c), (e) and (f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter GDPR. The data is processed for the duration of the User's account in the Repository and, after the account is deleted, for the duration of the retention of the data uploaded by that User in the Repository and 5 years after deletion.

Personal data collected in the Repository may be shared with third parties for the purpose required for the proper functioning of the Repository, and only to the extent necessary. Data collected in the Repository may also be shared with third parties in other cases specified by law.

A data subject has the right (as defined in GDPR) to:
- access to his/her data (Article 15 of GDPR);
- rectify (amend) his/her data (Article 16 of GDPR);
- erasure of the data (Article 17 of GDPR);
- restrict data processing (Article 18 of GDPR);
- object to the processing of the data (Article 21 of GDPR);
- withdraw his/her consent at any time (Article 7 of GDPR);
- lodge a complaint with the President of the Office for Personal Data Protection, in case the processing of personal data is considered to violate the provisions of the GDPR (art. 77 of GDPR).

Providing personal data by the User is necessary for registration in the Repository. Refusal to provide the data will result in inability to use the Repository.
6. Liability

ICM UW makes every endeavour to make the use of the Repository possible without any significant interruptions and disruptions, and with the employment of the largest possible number of configurations of software and hardware available on the market. However, ICM UW doesn’t make any warranty, particularly as to the quality of the Repository, its fitness for any purpose whatsoever, as well as to the absence of explicit or hidden physical or legal defects.

Upon receiving an official note or obtaining any reliable information regarding an unlawful character of Materials or activity associated thereof, ICM UW shall foreclose access to the Materials without any delay.

ICM UW may refuse registration or may delete the account of any User who acts in breach of these Term of Use and, despite notice, does not remedy the breach in due time, but not longer than 14 days.
